After Bostock: Best Practices for Employers Protecting their Transgender Workers

The historic June 2020 Bostock Supreme Court decision held that the Civil Rights Act of 1964 protects people from discrimination in employment on the basis of their actual or perceived sexual orientation or gender identity/expression. For Pride 2021, Major Lindsey & Africa's Outlaws Employee Resource Group; members of the Transgender Legal Defense & Education Fund; Sophia Lee, partner and chief diversity and inclusion officer emeritus at Blank Rome; and Mary Cate Gordon, assistant general counsel at Exelon, explored how to build a workplace culture of inclusion and belonging for members of the LGBTQ+ community. They discussed:

  • Vocabulary and Trans 101
  • Best practices in the workplace
  • Onboarding/recruiting
  • Transition policies/working with trans clients and colleagues
  • Implications of Bostock and upcoming cases/trends
